Implementation of Actual OROP-Letter to Raksha Mantri

Dear Raksha Mantri, 

1.                  This has reference to my meeting with you on 15 Nov 2017 regarding Implementation of Actual OROP.

2.                  As discussed, rectification of Anomalies in the Govt Notification of 07 Nov 2015 is essential to ensure Implementation of Actual OROP.  You are aware that an Average Model of Rs 5500 has been implemented instead of Actual OROP which as per the 6^th CPC scales works out to be Rs 8300 Cr.

 3.                  What has been implemented falls short of the OROP.  The definition of OROP has been amended which kills the very soul of OROP.  You are aware that Definition of OROP has two distinct Parts:-

(a)         Defence Personnel with the Same Rank and same years of Service will get same Pension irrespective of the date of retirement.

(b)        Any change in the rate of Pensions will be automatically passed to the  past pensioners.

 4.                  The above definition implies that current pensions will be paid to the defence personnel with the same rank and same years of service.  It also implies bridging the gap in pensions between the current and the past pensioners with the same rank and same years of service.

5.                  You are also aware that the OROP implementation Notification dated 07 Nov 2017 has changed the Definition part two ie “Instead of change of rate in pensions will be automatically passed to the past pensioners, it has been amended to read, “equalization of Pensions will be carried out at Periodic intervals”.  This implies that many of the junior defence personnel of the same class will get more pensions than their seniors of the same class. This will be against the Constitution Article 14.  No senior should ever draw less pension than his juniors.

6.                  Implementation of Actual OROP was assured by the Ho’ble Prime Minister.  We request that the Actual OROP be implemented to correctly execute the concept of OROP.  In this connection Govt Executive Order dated 26 Feb 2014 is enclosed.

7.                  As already brought to your notice, important issues concerning Defence Personnel requiring immediate redressal are once again enclosed.
